I think you need to be taken somewhere else for it to be a kidnapping. At any rate, kidnapping was clearly not the intent given the guy called the police and held on to his victim until they showed up. And before morons come in and say it had nothing to do with race, the State Attorney admitted it was racial profiling in his statement. What exactly do you call “committing a crime against someone because of their race” then?
