But it won’t even take that…when dozens of people from the same family show up at the hospital, the hospital shares that data. When two of the family members were at church service, and then 20 of those people show up too, it’s starting a pattern. Then when workers at the grocery store near where the church members live start getting infected…it’s not hard to put the pattern in place.
Gohmert has a duty of reasonable care. If he creates harm he has a duty to mitigate it. Here, he knew he had Rona, knew it was transmittable and dangerous and breached that duty by exposing others. However, the other elements are very hard to prove. Any staffer that got sick would have to prove they contracted it from Gohmert and not randomly on the bus or from their spouse. Since there is no contact tracing or way to identify specific strains it would be really hard to prove.
